Nantucket County Commissioners, 437 Mass. 430 (2002), which involved an unauthorized taking of private property allegedly for public use, and Gifford v. Planning Board of Nantucket, 376 Mass. 801 (1978), in which a division of a tract of land was incorrectly excepted from the Subdivision Control Law
