The firm's Bankruptcy and Creditors' Rights Group is widely recognized for its expertise in complex restructurings and insolvency proceedings. Our attorneys have played key roles in many major bankruptcy cases in New England and throughout the country.  Jager Smith P.C. represents debtors, secured and unsecured creditors, creditors' committees, court-appointed trustees and receivers and acquirers of assets out of bankruptcy.  In addition to our participation in bankruptcy cases, we provide expertise in a wide variety of sophisticated financial transactions, including out-of-court workouts, assignments for the benefit of creditors and compositions.

Bankruptcy Negotiation and Administration

The members of the Bankruptcy and Creditors' Rights Group have extensive experience in the negotiation, documentation and confirmation of plans of reorganization and the administration of reorganization proceedings.  Our attorneys are specialists in guiding debtors, individual creditors, creditors' committees, banks and institutional groups through the reorganization process.  This requires technical knowledge of all aspects of the Bankruptcy Code as well as a refined understanding of the financial, operational and management difficulties that a debtor may be facing.  The experience of the firm's attorneys also provides our clients with invaluable access to a broad network of insolvency professionals, which includes specialized insolvency consultants, liquidations specialists, potential lenders and investment banking firms.

Bankruptcy Litigation

Litigation has become an integral part of most substantial Chapter 11 cases.  Jager Smith P.C. has significant strength in this area, having litigated matters involving, among other issues, fraudulent conveyances, preferential transfers, adequate protection of creditors, requests for relief from the automatic stay, conversion motions, objections to proposed financing orders and the sufficiency of disclosure statements and plans of reorganization.
