Mr. Fencer is an associate in the firm's Bankruptcy and Creditors' Rights and Litigation Groups. His primary areas of practice are commercial insolvency and reorganization, commercial litigation and construction law, and administrative law. In his practice, Mr. Fencer has represented and counseled corporate and other business debtors, creditors and official committees of unsecured creditors, bankruptcy trustees, and other parties in interest in bankruptcy proceedings in United States Bankruptcy Courts in Massachusetts, New York, Delaware, Florida, and Mississippi. In his insolvency practice, Mr. Fencer has also advised and represented various parties to distressed merger and acquisition transactions, as well as asset and stock transactions. In addition, Mr. Fencer has prosecuted and defended claims on behalf of clients in state and federal trial and appellate courts involving matters such as fraudulent and preferential transfers, directors and officers liability and insurance coverage claims, construction defects, and the enforcement of construction liens and bonds. Mr. Fencer also frequently represents licensed professionals and tradesmen in administrative enforcement and disciplinary proceedings before various state licensure boards and commissions. Prior to joining the firm, Mr. Fencer served as a Law Clerk to the Honorable Joel B. Rosenthal of the United States Bankruptcy Court for the District of Massachusetts. He received a Bachelor of Science, magna cum laude, from Suffolk University College of Arts and Sciences and a law degree, cum laude, from Suffolk University Law School, where he was Vice President of the Moot Court Honor Board and earned Suffolk Jurisprudence Awards in Environmental Law and Secured Transactions. Mr. Fencer is admitted to practice in the Commonwealth of Massachusetts, the United States District Court for the District of Massachusetts, and the United States Court of Appeals for the First Circuit. He is also a member of the Massachusetts Bar Association, the Boston Bar Association, the Turnaround Management Association, and the American Bankruptcy Institute. In 2005, 2006, and 2007 Mr.
Fencer was named as a Rising Star in the bankruptcy and workout community
in the Massachusetts Super Lawyers -- Rising Stars Edition, an
annual list compiled by Law & Politics which is mailed to
every lawyer in Massachusetts and which appears as a special supplement
in Boston Magazine.
