Jager Smith’s Environmental Law Group provides experienced counsel on all aspects of environmental litigation, compliance and due diligence. Our attorneys have recognized expertise in the areas in which our clients face environmental issues, including high stakes litigation, bankruptcy and restructuring and commercial real estate development.

Our attorneys have particular experience in negotiaing and litigating the costs and responsibilities of remediating contaminated properties, defending companies in goverment administrative and enforcement proceedings, and successfully working with government agencies to resolve regulatory issues and other disputes.

The Environmental Law Group is led by partner Bruce Smith, whose more than 35 years’ experience includes serving as the Chief of the Environmental Protection Section of the United States Attorney’s Office for the Eastern District of New York.  Because environmental issues often arise in the context of complex business and real property transactions, we regularly draw on the expertise of our corporate, tax, real estate, litigation and bankruptcy and restructuring attorneys to best serve our clients’ interests.

Our attorneys have successfully represented clients in a wide range of environmental matters, including:

  • Guiding owners and operators of contaminated properties and facilities through all phases of the cleanup process under CERLCA and state environmental statutes such as Massachusetts “Chapter 21E,” including working closely with LSPs in site assessment and the identification of remediation options
  • Negotiating and, if necessary, litigating the recovery and allocation of remediation costs among property owners, other responsible parties and government agencies.

  • Litigating and successfully resolving environmental insurance coverage issues.

  • Resolving issues of environmental liability and costs arising in Bankruptcy.

  • Defending and responding to government environmental enforcement actions and investigative demands into alleged violations of air, water and hazardous waste regulations and permits.

  • Representing clients in contested permit proceedings before government agencies and administrative bodies.

  • Advising clients on due diligence related to the acquisition of potentially contaminated property
